Who is Liable in Bike Accidents?

Who is Liable in Bike Accidents?

The California Motor Vehicle Code governs and protects everyone on the roadway, not just drivers of motor vehicles. Bicyclists also are subject to various state laws to keep everyone safe, as well as municipal traffic codes that exist in many cities. When a bike accident does occur, however, the ability to bring a valid personal injury claim depends largely on who is negligent and thus liable for the accident that occurred.

Every bike accident case is different, and as a result, the liable parties may vary. In many cases, drivers are negligent in hitting bicyclists and cause them severe injuries. Drivers may be negligent in many ways, such as if they are driving while distracted, driving while impaired by drugs or alcohol, or carelessly committing traffic violations. Speeding, failing to signal turns, and failing to give bicyclists at least three feet of room when passing them all can have devastating results for bicyclists involved in these accidents.

As mentioned above, however, bicyclists also must obey the rules of the road. These rules include riding in designated bike lanes or as close to the right side of the road as possible, except in specified circumstances. Bicyclists also must have various reflectors and lights on their bikes when riding at night. Failing to follow these rules can make bicyclists partially negligent for any accidents that occur. In this case, bicyclists and drivers may share liability for the injuries that result from a crash. Many of California’s bicycling laws can be found in the California Vehicle Code 21200 section.

Other entities could be liable for bike accidents, as well. For example, if an employee of a business was negligent in causing a bicycle crash, then not only the employee but also the company may be liable for any injuries that occur. Likewise, if a bicyclist crashes and suffers injuries due to an unmarked hazard on a city-maintained road, the city may be liable for those injuries in some instances.
