How Long Do I Have to File a Bicycle Accident Claim?

How Long Do I Have to File a Bicycle Accident Claim?

Every state has a different statute of limitations or a deadline for people to file personal injury claims against any potentially liable parties. This statute of limitations also applies to individuals who are injured in bicycle accidents.

With a few exceptions, in the state of California, the statute of limitations for filing a personal injury action related to a bicycle accident is two years from the date of the accident. For minors involved in bicycle accidents, however, the two-year statute of limitations does not begin to run until they turn 18 years of age. Therefore, they can file their claims at any time up until they become 20 years old, no matter how many years it has been since they were injured as a minor in a bicycle accident.

Failure to meet this deadline or statute of limitations is likely to result in your complete inability to file a personal injury claim against any parties. Even if another motorist or other party was liable for the accident that caused your injuries, you generally can not bring a claim seeking damages for your injuries against any party once the statute of limitations has passed.

A different statute of limitations applies in cases involving a government body, such as a city, county, or the state of California. When a government body or unit is potentially liable for a bicycle accident that led to injuries, injured parties must file their claims within six months of the date of the accident, even if they were minors at the time of the accident. Again, if individuals do not meet this timeframe in filing their claims, they may be left with no recourse for recovering damages for the losses related to their injuries.
