Once a long-term disability claim has been denied and an appeal has been made, the insurance company usually has between 30 and 70 days to review it and make a decision. If an appeal is denied, making it the second denial, the next step would be to file a lawsuit in court under ERISA. Some policies have an exclusion so that they can have a second appeal, but most require you to file a lawsuit after that. Once you get to that stage, it is imperative to have an attorney to make sure that all of the legal proceedings and procedures leading up to and filing a long-term disability lawsuit are initiated correctly.
